4. Allowed uses
A: The End User shall have the right to copy or transfer any purchased download to any desktop computer, laptop computer, mobile phone, or playback device owned by End-User, and/or to a recordable medium (such as CD-R or DVD-R) for End User’s personal use only.
B: The End User shall be entitled to play any purchased download as disc jockey in its performances and submit the playlist information for any use of downloads as part of such disc jockey performances to the relevant performing rights society(ies).
5. Prohibited uses
A: The End User shall not copy or transfer any purchased download to any desktop computer, laptop computer, mobile phone, or playback device not owned or regularly used by End User!
B: The End User shall not copy or transfer any purchased download to a recordable medium (such as CD-R, DVD-R) which the End User distributes or sells to any third parties!
C: The End User shall not upload or transmit any purchased download to any website or other medium accessible by any third party via the Internet or otherwise and End User hereby expressly agrees not to make any purchased download available to any third party through so-called «file sharing» services. Peer-2-peer file sharing is STRICTLY PROHIBITED!
D: The End User may not copy, reproduce, modify, rent, lease, transmit, distribute or otherwise disseminate any purchased download on the website except for your own personal, non-commercial use.
6. Prices, special offers and promotions
A: All details, descriptions and prices for the product appearing on the Website are correct at the time when the information was entered. The price that is listed at the time of your order on our website is the price that you pay.
B: Roberto De Carlo reserve the right to adjust at any time without notice the price and specification of any item on the Website at its discretion.
C: Prices that are reduced for sales and promotions are only valid for the specified period. We do not provide price protection or refunds in the event of a price drop or a promotional offering.
7. Payment and delivery
A: All payments are processed securely by PayPal (www.paypal.com). Pay by Paypal System using your PayPal account or Credit Cards (Visa, Mastercard, American Express and many more) in this case you don’t need PayPal account. Pay easily and securely. There will be no additional cost for you, no matter the payment method selected.
B: When you submit your order, you are confirming that your payment details are valid and correct. All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, or PayPal is unable to contact your card issuer, we will not be liable for non-delivery.
C: After a successful payment we will confirm that your order has been received by sending an email to you at the registred email address and the purchased product is immediately activated under your account in the section «My Downloads» for 48 hours and/or the maximum amount of 3 downloads.
8. Refund Policy
A: There are no refunds once a download is purchased. When you click the «Buy Now» button, or another button confirming your purchase, your music purchases are charged to the credit card or authorized payment method.
B: You are responsible for ensuring that you have carefully checked that your order reflects accurately the digital content that you want to receive before submission and that your computer meets the minimum systems requirements. Delivery of digital content specified in your order that you do not want or incomplete delivery or functioning as a consequence of your failure to observe the minimum service requirements, will not constitute grounds for cancellation, refund or exchange.
9. Risk of Use
Roberto De Carlo assume no responsibility and shall not be liable for any damage to your computer system or loss of data that results from digital content, materials or software and we cannot ensure that any files you download from the Website are free of viruses, contamination or destructive features.
10. Termination
A: Roberto De Carlo may in its absolute discretion and without notice to you terminate this agreement or suspend your account at any time if Roberto De Carlo (in its reasonable opinion) believes that you have breached the provisions of the terms & conditions.
B: Customers are entitled to cancel an account at any time. If you wish to do so, please contact us using our comfortable contact form on the Site or send directly an email to support@robertodecarlo.com and we will remove all stored details connected with your account from our database and ensure that you no longer receive any communication. You may be prompted for a reason why you wish to cancel your account, this is in order for us to develop our service and ensure that we are providing total customer satisfaction.
